Privacy Notice


Dear parent’s/carers this Privacy notice describes how in accordance with the General Data Protection Regulation (GDPR). Angels Nursery is a “data controller”. This means that we are responsible for deciding how we hold and use personal information about you. We are required under data protection legislation to notify you of the information contained in this privacy notice. This notice applies to parents/carers and their children.
Data Protection principles:
We will comply with data protection law. This says that personal information we hold about you must be:
1. Used lawfully, fairly and in a transparent way.
2. Collected only for the valid purposes that we have clearly explained to you and not used in any way that is incompatible with those purposes.
3. Relevant to the purposes we have told you about and limited only to those purposes.
4. Accurate and kept up to date.
5. Kept only as long as necessary for the purposes we have told you about.
6. Kept securely.
The kind of information we hold about you and how it is collected:
Personal data, or personal information, means any information about an individual from which that person can be identified. It does not include data where the identity has been removed (anonymous data). There are “special categories” of more sensitive data which require a higher level of protection, such as information about a person’s health.
We collect, store and use the information you provide on your child’s application form, and any other forms you complete, and information we produce during your child’s time at Angels nursery. This includes but is not limited to; names; addresses; phone numbers; date of birth; dietary requirements; photographs; children’s progress along the EYFS; accidents; incidents; medicine administered; attendance; languages spoken; and emergency contacts.
How we will use the information you provide:
We will only use your personal information when the law allows us to. Most commonly, we will use your personal information in the following circumstances:
1. Where we need to perform the contract we have entered into with you.
2. Where we need to comply with a legal obligation.
3. Where it is necessary for our legitimate interests (or those of a third party) and your interests and fundamental rights do not override those interests.
We may also use your personal information in the following situations, which are likely to be rare:
1. Where we need to protect your interests (or someone else’s interests)
2. Where it is needed in the public interest or for official purposes.
If parents/carers fail to provide personal information:
If parents/carers fail to provide certain information when requested, we may not be able to perform the respective contracts we have entered into with parents/carers or we may be prevented from complying with our respective legal obligations to children and parents/carers. This may impact our ability to provide a nursery service for your family.
Automated decision - making
Angels nursery does not use automated decision making.
Data sharing
We will share your personal information with third parties where we are required by law, where it is necessary to administer the working relationship with you or where we have another legitimate interest in doing so.
“Third parties “includes third-party service providers (including contractors and designated agents), local authorities, regulatory bodies and schools. The following third party service providers are an example of those who may process personal information about you for the following purposes;
▪ Local Authorities – for funding and monitoring reasons
▪ Regulatory bodies – for ensuring compliance and the safety and welfare of the children
▪ Learning journey providers – to provide a comprehensive overview of children’s development and meet our regulatory requirements
▪ Schools – to provide a successful transition by ensuring information about children’s progress and current level of development and interests are shared.
All our third-party providers are required to take appropriate security measures to protect your personal information in line with our policies. We do not give permission to our third –party service providers to use your personal data for their own purposes. We only permit them to process your personal data for specified purposes and in accordance with our instructions.
Data retention:
We will only retain your personal information as long as necessary to fulfill the purposes for which we collected it, including for the purposes of satisfying any legal, accounting, or reporting requirements. Details of retention periods for different aspects of your personal information are available from the nursery Manager.
Rights of access, correction, erasure and restriction:
It is important that the personal information we hold about you is accurate and current. Please keep us informed if your personal information changes during your child’s time with us.
Your rights in connection with personal information:
Under certain circumstances, by law you have the right to:
▪ Request access
▪ Request correction
▪ Request erasure
▪ Object to processing
▪ Request the restriction of processing
No fee is usually required. We may need to request specific information from you to help us confirm your identity and ensure your right to access the information (or to exercise any of your rights). This is another appropriate security measure to ensure personal information is not disclosed to any person who has no right to receive it.
Right to withdraw consent:
In the limited circumstances where you may have provided your consent to the collection, processing and transfer of your personal information for a specific purpose, you have the right to withdraw your consent for that specific processing at any time. To withdraw your consent, please contact the nursery Manager. Once we have received notification that you have withdrawn your consent, we will no longer process your information for the purpose you originally agreed to, unless we have another legitimate basis for doing so in law. This may impact our ability to provide a nursery service for your family.
All policies and procedures are reviewed annually by the company, however should any policies and procedures need to be changed before the review date information of any changes will be communicated to all parents.
